Basics of the Law

There are two types of Medicaid. Community Medicaid takes place when you are able to live in the Community. Transfer penalty rules do not apply. There are different property and income exemptions when you are married as opposed to being single. The use of pooled Trusts may allow you to keep much of your income above the allowable standards.

Nursing Home Medicaid (Chronic Care) does have transfer rules and penalty periods. The law changed in 2/06 and transfers made before that time are given the more favorable treatment of the prior law. However certain assets may be exempt and certain transfers are exempt. The property and income exemptions are significantly different depending whether you are married or single.
